Terms and Conditions of Website Usage

 

1.   The owner of this Site (the “Site”) is Torture Gardens Productions Ltd whose address is  London, E2 8HD (‘TG/’we’/’us’/’our’) Re18 Rotherhithe New Road, SE16 3EH, Registration number 4516358. Trading names include Torture Garden, TG Productions and TG.

These terms and conditions govern your use of this Site. By using the Site, you accept these Terms and Conditions (“Terms” / “T&Cs”) in full.  If you disagree in any way you must not use our Site.

The material on this Site is adult in nature and sexually oriented. By using this Site you warrant and represent you are at least 18 years of age. If you are under 18 years of age you must not view or use this Site, and we accept no liability for your usage or any direct or indirect consequences of such usage.  Please see the Site’s disclaimer, available on the home page when you choose to enter the Site.

Registration as a Photographer:  If you register as a Photographer , you expressly agree to these Terms.

2. Rights and Licence to use Site.

Unless otherwise stated, TG and its licensor own all intellectual property rights in the Site and material on the Site. And all such rights are hereby reserved.

You may view, download for caching purposes only, and print pages, stream audio and video files (“Material”) from the Site from a web browser for your own personal use, subject to any other restrictions in these Terms.

You must not republish material from this Site, including republication on another Site; sell, rent, or sub-licence Material from the Site, show any Material from the Site in public unless permission has been expressly granted, reproduce, duplicate, copy or otherwise exploit Material for a commercial purpose.

You must not use this Site in any way that causes, or may cause, damage to the Site or impair the Site’s availability or accessibility; or in any way that is illegal, fraudulent, or harmful, or in connection with any unlawful, illegal, fraudulent, or harmful purpose or activity. You must not use this Site to copy, store, host, transmit, send, use, publish, or distribute, any material which consists of or is linked to any spyware, computer virus, worm, rootkit, Trojan horse, or other malicious computer software.

Restricted access: Photographer’s Panel or any other areas.

 

We reserve the right to restrict access to the Photographer’s Panel or any other areas of the Site. You must not circumvent or bypass any access restriction measures on our Site.

If you register for an account with our Site, you will be asked to provide a User ID and password. You must keep your password confidential. You are responsible for any activity on our Site arising out of failure to keep your password confidential, and may be held liable for any losses arising out of such a failure.

 

 

Photographer’s content:

“Your Content” means any material (including and without limitation, text, images, audio, video and audio-visual material you submit to this Site, for whatever purpose. By submitting Your Content, you grant to TG a worldwide, irrevocable, non-exclusive, royalty-free licence to use, reproduce, adapt, publish, translate, and distribute Your Content. You grant us the right to bring an action for infringement of these rights.

Your Content must not be illegal or unlawful, must not infringe upon the rights of any third party, and must not be capable of giving rise to legal action whether against you are a third party, under any applicable law.

We reserve the right to remove any of Your Content submitted to the Site, or stored or published upon this Site.

 

 

3. Ticket Purchases.

We only sell tickets online, they are purchased either via our website, ir if a venue has an allocation to sell, we will link to that via our website

 

(i) Secure online transaction: e-tickets are available via our agent Eventbrite.  While on our Site, once you decide to purchase tickets, you will be taken to Eventbrite’s Site to submit details and complete the transaction. We are known as the “event promoter”, noted on the e-ticket.

You will receive a confirmation e-mail from Eventbrite, to the e-mail address provided at the time of purchase. You must check that the details on this confirmation e-mail are correct as soon as possible and you should either download the ticket to your phone or print it

If there are any changes to the details supplied by you it is your responsibility to inform Eventbrite as soon as possible.

Once you purchase the ticket via Eventbrite, you will be able to print your e-ticket, which will be scanned upon arrival. You can also download your ticket to your mobile phone, which will also be scanned upon entry to the venue.

By ordering any tickets you undertake that these are for your own private and domestic use only.  Your agreement as indicated by using this Site, and purchasing a ticket for an Event via Eventbrite, is a positive indication that you accept these Terms as listed and you are bound to these Terms.

Tickets are sold as Non-Refundable. Sales are final. Eventbrite has no way to exchange tickets for a different party, sales are final. If an event sells out far enough in advance that it warrants TG running an in house returns and waiting list system, instructions will be posted on the event page on the TG website, however this isn strictly at TGs discretion and only available if a party has sold out to capacity more than a week before an event. If TG has not posted that they are offering this system on the relevant event page on their website, then they are not able to offer any kind of refund or exchange for that event.

 

Attendance.

TG Events are extreme events, and entry to the Event is subject to compliance with a dress code that we do not make exceptions to. Please see your ticket and/or the Site for details. TG reserves the right to refuse admission to anyone not adhering to the dresscode AND REFUNDS WILL NOT BE MADE.

The unauthorised use of cameras, audio and video equipment is not permitted. You may be ejected from the venue/ Event without recourse to refund if you are found using any such equipment without our express permission.

Many venues have a “final admittance” time, if you are arriving late, it is your responsibility to check at what times the doors will close for that event.

For security reasons, bags may be searched as a condition of entry.

 

ID Scanning:  Some venues enforce a policy of obligatory ID scanning as a condition of entry. If a venue  will be carrying out this policy at a given event, this will be written on the event information on the website and on your ticket. We have no control over such policies, and you must bring the appropriate ID in order to enter.

Failure to bring the appropriate ID will disallow you from entering the venue, and you will NOT BE ENTITLED TO A REFUND.

 

Conduct:  TG enforces a strict code of conduct, which is explained in these Terms and on the Website.  If you are found to violate this code, you will be ejected from the Event with NO REFUND.

 

 

Cancellations, Returns, Exchanges.

We regret that once purchased, tickets are non-cancellable, non-exchangeable and non-refundable, unless the Event has been cancelled or re-scheduled.

 

 

4. Liability

This section applies only to the extent permitted by law. For the avoidance of doubt, we do not exclude or limit any liability for (a) personal injury (including sickness and death) where such injury results from our  negligence or wilful default, or that of our employees, agents or subcontractors or (b) fraudulent misrepresentation.

This Site is provided “as is” without any representations or warranties, express or implied.  We do not warrant that the Site will be constantly available or that the information on the Site is complete or accurate. We will not be liable to you in relation to the content, Your Content (in terms of the Photographer’s Panel), any content you may have otherwise submitted, of or use of this Site for any indirect, special, or consequential loss.

We do not accept liability for any errors and omissions and reserve the right to change information, prices, and descriptions about Events. We will do our best to correct errors and omissions as quickly as practicable after being notified of them.

We have no liability to you for any delay or cancellation of any Event to the extent that the delay or cancellation is due to any event outside our reasonable control, including but not limited to acts of God, war, flood, fire, labour disputes, strikes, lock-outs, civil commotion, terrorism, explosion, governmental actions or any other similar events.

 

5.  Miscellaneous

No waiver by us of any breach of these Terms shall be considered as a waiver of any subsequent breach of the same or any other provision.

We reserve the right to terminate this Agreement we suspect you have engaged, or have in any way been involved, in fraudulent or illegal activity on the Site or as part of your ticket purchase.

We may amend these Terms from time to time, and will place the new version on the Site.   Your continued use of the Site following our posting of any changes will constitute your acceptance of such changes. If you do not agree to any changes to these Terms, then you should cease using the Site.

These Terms supersede any and all other conditions, understandings, commitments, agreements or representations (except fraudulent misrepresentations) relating to your purchase, whether oral or in writing, and contain the entire agreement between you and us.  We advise that you print off a copy of these terms and conditions and should keep a copy safe.

If any provision of these Terms shall be held by any competent authority to be invalid or unenforceable in whole or in part, the validity of the remaining parts of these Terms and the remainder of the affected provision shall be unaffected.

These Terms and Conditions are subject to the laws and exclusive jurisdiction of England.
